TERMS AND CONDITIONS:
These general terms and conditions of sale are agreed between the company ELLIPSE NUTRITION with tax designation MCVT SPORT&FITNESS LDA, headquartered at Rua Visconde Gemunde, nº671 4760-392, V.N. Famalicão with tax identification number 509 994 822 and contact +351 252 080 647, hereinafter referred to as “ELLIPSE FITNESS®“ and people who wish to make purchases through the website www.ellipse-nutrition.com hereinafter referred to as "User".

 

OBJECT:
- The purpose of these general terms and conditions of use is to define the conditions of access to and navigation on the website by the customer who intends to make purchases in the online store. The general conditions of sale are intended to regulate the terms of operation of commercial transactions carried out between ELLIPSE NUTRITION and the Customer.
- The Privacy Policy aims to identify privacy protection measures with regard to the processing of personal data and the free movement of data of natural persons, including the personalized management tools for personal data provided by customers.


TYPES OF PERSONAL DATA COLLECTED:
- In general terms, personal data is collected in three situations directly resulting from the activity of ELLIPSE NUTRITION.
- User registration: creation of the ELLIPSE NUTRITION customer account and purposes of data processing:
- For the purpose of creating the customer account, a customer area is available in which you must enter the data necessary for your identification as a customer. Making the first purchase will depend on the provision of additional personal data, essential for order processing and delivery.
- Mandatory fields in the forms available for those stages of registration are marked with an asterisk (*).
- ELLIPSE NUTRITION undertakes to protect customer data and these will never be made available to third parties without the owner's knowledge or consent, as legally required.
- When processing the customer's order, it is possible that certain personal data (such as address and postal code) are disclosed to third parties for the sole purpose of preventing and detecting fraud and always following a request for this purpose by the of the competent authorities. In addition, when making a purchase on the website, data regarding the delivery address and payment details will also be requested, in order to guarantee the greatest possible efficiency and compliance with delivery deadlines.
- The data provided will be kept for the strictly necessary period, which normally corresponds to the period of existence of the customer account. For this reason, when the customer triggers the cancellation of the customer account, the personal data will be definitively erased, with the exception of the data necessary for the fulfillment of legal obligations that will be filed in a database specific for this purpose and for a period absolutely necessary. If you wish to place a new order on the website, the customer must proceed with a new initial registration, subject to the terms and conditions in force at the time of registration.
- We may also collect other information about the customer's experience on the site for the sole purpose of improving the service to be provided to the customer, which we will do after confirmation of knowledge and, when necessary, after the express consent of the holder of the personal data.

 

GENERAL SALE REQUIREMENTS: Order and Purchase Process.
- Deadline and Payment Methods: After completing the ordering process in the customer account, the customer has a period (24 hours), selecting the payment method, to proceed with the payment. After this period, the order will be cancelled.

- ELLIPSE NUTRITION offers the following payment methods for purchases made in the online store:
- Credit Card: Customers can pay by credit card and enjoy the liquidity advantages and payment terms offered by their bank. All transactions on our website are secure.
- Multibanco: Multibanco payments can be made through the Multibanco ATM Network or through your Homebanking. When finalizing your order, an ATM reference will be generated. The customer will receive this reference in the order confirmation email. To pay at an ATM, the customer must select the option "Payment for Services/Purchases" and enter the corresponding entity, reference and amount.
- Bank transfer, or others presented for this purpose. It will always be subject to the option of choice by the user.
- If, after 24 hours, the customer has not made the transfer, the order will be cancelled.

- Warning: Payments are always made in Euros, even when prices are shown in other currencies. Some banking entities may charge exchange fees. ELLIPSE NUTRITION is completely unaware of this fact, and therefore assumes no responsibility for it.

- Depending on the country in question, ELLIPSE NUTRITION can provide other payment methods whose detailed description will be provided, upon request, by the Customer Service:

- Warning: In view of the current economic situation and recently verified international constraints, not all payment methods may be available at the same time. For this reason, the identification and conditions of use of each payment method available at any given time are published in the last step of the ordering process, immediately prior to its confirmation. Such conditions will, as such, only be valid for the respective purchase, considering, for this purpose and whenever applicable, the period of validity thereof.

 

RETURN TERMS:
- Return of defective products: The customer is entitled to a return if it is found that the products supplied are defective or otherwise non-compliant with the items ordered.
- The return of incomplete, damaged or scratched products, as well as products without the original packaging and/or label, or products with evidence of having been used, will not be accepted.
- The defect must be communicated within a maximum period of 48 hours after receiving the product to the email info@ellipse-nutrition.com.
- The customer must attach photographs/videos to the e-mail that prove the non-compliance of the packaging/product.
- The return can be made within 15 days after notification of the defect against presentation of the original invoice and the product must keep all the original elements.
- The seller will analyze the returned product and inform the user of the right to a refund (if applicable), or exchange for the same or another product, depending on the customer's option (bearing in mind that any exchange for a valuable item higher, the customer will have to pay the difference).
- As a rule, the seller proceeds with the refund within 15 working days from the date of confirmation via e-mail of the right to refund.
- For returns and exchanges, the customer must request it via email info@ellipse-nutrition.com.
- If the defect or non-compliance is confirmed as justifying reasons for the return, the entire amount paid will be refunded. The refund of the amount paid will be made by bank transfer. These provisions do not affect your statutory rights.
Each of the items to be returned must, therefore, be shipped under the conditions listed above, and the freight forwarder's label must be affixed to the original shipping box, or another alternative that guarantees the good preservation of the product, which will be destroyed after confirmation of the condition conservation of the returned product(s).
- If any of the above conditions are not met, the customer will lose the right to be refunded.

 

THE RIGHT TO RETURN ONLY OCCURS IF THE PRODUCTS:
- Have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories but cannot use them.
- Keep the original characteristics and the packaging is not damaged (packages opened carefully will not be considered damaged).
- Are complete (eg both items in a pair must be returned).
- Have not been tampered with and keep the identification label, if the product has such a label.
- All items that are manufactured by customization are not subject to return.

 

OFFER RETURNS:
In addition to the conditions specifically set out in the previous number, the customer should also take into account whether the product he intends to return was purchased as part of a promotional campaign and whether, for that reason, he benefited from any product on offer. This being the case, the customer must return not only the product in question, but also the gift given with his purchase. Both products must comply with the aforementioned guidelines.
- The return of a offered product must be made by the person who offered/purchased it, with presentation of the original invoice.
- If the defect or non-compliance is confirmed as justifying reasons for the return, the entire amount paid will be refunded. The refund will be made to the debit or credit card used to make the purchase or by bank transfer.
The right to return only occurs, provided that the products:
- Have not been washed or used (unless the product contains information to the contrary). The customer has the right to try the equipment and accessories, but cannot use them.
- Keep the original characteristics and the packaging is not damaged.
- Are complete (eg both items in a pair must be returned).
- Have not been tampered with and keep the identification label, if the product has such a label.
- All items that are manufactured by customization are not subject to return.
- The customer is responsible for the costs of returning and shipping the returned goods.
- Pack return: It can be done in its entirety, or if the customer intends to return only certain products from this pack, he must return the products that constitute it under the conditions mentioned above. The return of the corresponding amount will be made in the aforementioned manner.

EXCHANGE FOR SIZE OR OTHER ITEMS:
- To exchange an article for another article, it is necessary to request the exchange via email info@ellipse-nutrition.com.
- An item can only be exchanged for another of equal or greater value and products can only be exchanged once. If after the exchange order you are not satisfied, you can only return your order and place a new order.
- The customer is responsible for the costs of returning and shipping the returned goods. The return must be accompanied by the original invoice.
The right to exchange only occurs within the previously mentioned parameters.

 

SHIPPING & CARRIERS:
- We deliver orders from Monday to Saturday. Shipments are not made on certain holidays (you can get confirmation by sending an email to sales@ellipse-fitness.com).
- We guarantee the delivery of an order at the requested address, whether it is a home or a place of work and deliveries are not made to PO Boxes.
- The preparation and dispatch of the order from the warehouse may take up to 2 working days (5 working days for large volume orders) after confirmation of payment.
- After dispatch, delivery time varies depending on location and carrier.

 

SHIPPING CHARGES:
Shipping costs are automatically calculated by our system and depend on the following factors:
- Actual weight of the order;
- Carrier tariffs, which undergo periodic updates;
- Customer shipping address.

 

TRANSPORT TIMES:
- ELLIPSE NUTRITION works in partnership with carriers so that the following shipping times can be ensured. However, these may vary for reasons beyond the control of ELLIPSE NUTRITION.
- Mainland Portugal: 1/2 working days (5 working days for bulk orders)
- Islands (Azores/ Madeira): Between 5 to 8 business days.
- Spain: 2/3 working days (5/7 working days for bulk orders).
- For other European countries in small volume orders, the delivery forecast is up to 3/5 business days.
- For the remaining European countries in large volume orders, shipments are weekly, shipped on Friday, with delivery up to 7/10 working days.
- For the remaining countries outside the European continent, for small volume orders, the delivery forecast is up to 15 working days.
- For the remaining countries outside the European continent in large volume orders, the delivery forecast will be subject to prior consultation.

 

REFUSED ORDERS:
- Refusal to receive or non-delivery, for reasons not attributable to ELLIPSE NUTRITION or the carrier, will determine the loss of the right to refund the shipping costs of the order.
